Image Capture software is still a PowerPC software which means that you need Rosetta subsystem in order to run on a Intel based Mac.
This means the latest version of Mac OS you can use with Image Capture 4.1 is Mac OS 10.6.8 (Snow Leopard)

Image Capture 4.0 for Mac OS X with PPC processor.
Image Capture 4.1 for Mac OS X with Intel processor.

NOTE: Rosetta is still required so it will not work past Mac OS 10.6.8
